Attorney Profile:

As Partner and Chief Litigator, John W. DeHaan has spent the last 22 years advocating for disabled clients to insure that they receive the disability benefits they rightly deserve.

Prior to forming The DeHaan Law firm, Mr. DeHaan was the Supervising Attorney for Binder and Binder, P.C.’s long-term disability department and managed this national disability litigation department, winning cases in both the federal and state courts from New York to California. He is admitted to practice law in the courts of the State of New York; the U.S. District Courts for the Eastern, Southern, Northern, and Western Districts of New York; the United States Court of Appeals for the Second Ninth and Eleventh Circuits; and the U.S. Court of Appeals for Veterans’ Claims.

During his tenure at Binder and Binder, he won a multi-million dollar disability verdict against Guardian Life Insurance Company of America in the Florida U.S. District Court. As lead counsel on Chapman v. Choice Care Long Island LTD Plan, he successfully argued that the doctrine of equitable tolling of time deadlines for persons with psychiatric disabilities applies in an ERISA disability context. Mr. DeHaan has also had tremendous success in representing clients who have been denied Social Security Disability by the Appeals Counsel, in Federal District Court.

Mr. DeHaan began his law career as a Litigation Associate for Menagh, Trainor, Mundo & Falcone, P.C., advocating on behalf of unions and union workers, drafting wills, living wills and health care proxies, and representing adoptive parents during adoption proceedings.

Mr. DeHaan graduated with honors with dual degrees in History and Economics from the State University of New York at Stony Brook. After winning an academic scholarship, he attended New York Law School, where he received his Juris Doctor and was Notes & Comments Editor for the New York Law School Law Review.

Mr. DeHaan is a member of the Nassau County Bar Association, the Suffolk County Bar Association and the Federal Bar Council, the Federal Bar Council, and National Organization of Veterans’ Advocates (NOVA).

He also was Adjunct Professor of Administrative Law at the State University of New York at Stony Brook.
